The sole ground for divorce is the irretrievable breakdown of a marriage based upon one of five facts as follows:

  • Adultery
  • Unreasonable behaviour
  • Desertion
  • Two years’ separation with consent from the other spouse
  • Five years’ separation

The only restriction is that you are unable to apply for divorce within the first year of a marriage. However, if your marriage has broken down within this time, there are alternative arrangements that you can come to in the meantime and I can advise you in relation to these.
